The purpose of this memorandum is to answer common questions about the scope of law enforcement officials when dealing with citizens.
Under martial law, law enforcement agencies – including the National Police, the Security Service of Ukraine, and the National Guard – were provided with additional authority to fight the enemy more effectively and protect civilian security.
It is useful for citizens to know how to communicate with law enforcement and understand their scope of authority, including allowed and banned practices; how to avoid danger; and, how to protect their rights when interacting with law enforcers.
To this end, experts from the Law in a Wartime Initiative and the NGO Just Group analyzed current legislation and compiled 18 questions and answers on communication with law enforcers in this unique period. Here are some of the topics covered in the memo:
- What action can be taken if you are stopped at a law enforcement checkpoint?
- What happens if there are no identity documents confirming Ukrainian citizenship or a person’s special status?
- Under what conditions can vehicles be stopped?
- Can an authorized person enter a person’s home or other property without a court decision?
